Flat fees, passed-through filing costs, and three IP-audit retainer tiers.

No hourly billing for prosecution. Government filing fees (USPTO + USCO) are passed through at cost on every invoice with the receipt. The fee letter you sign on day one is the fee letter you pay at closing.

Why most of our clients sit on a quarterly retainer.

The economics of one-off filings are noisy. A retainer flattens spend and gets us looking at your portfolio every 90 days — instead of being called in only when you've already shipped something we should have filed on. The Startup tier is what most ~25-person companies land on.

Retainers can be paused, downgraded, or upgraded at any quarter boundary. We do not lock you into multi-year terms.

Fee & engagement questions.

Do you bill hourly for any work?+
No prosecution work is billed hourly. The single exception is litigation we are pulled into mid-case (federal court IP litigation, not TTAB) where we bill blended hourly with a written budget. Every other engagement type — patents, trademarks, copyrights, IP audits — is flat-fee.
Are USPTO and USCO fees subject to change?+
Yes — these are government fees we pass through at cost. The schedule above reflects the April 2026 fee schedule. We send a one-page advisory whenever the USPTO publishes a fee revision, with a re-quote of any open files affected.
What happens if my application gets rejected?+
First two office-action responses are included in the standard non-provisional retainer. If a third response is needed, we'll quote based on the rejection complexity ($1,200–$3,600 typical). We never bill for clarifying interview-with-examiner discussions, which we frequently use to short-circuit prosecution.
How does the engagement contract work?+
A short engagement letter (3 pages) signed at retainer execution. It identifies the scope, the flat fee, the pass-through fees, and the conflicts check. There is no auto-renewal; quarterly retainers reset on calendar quarter and you opt-in to continue.
Do you take equity instead of cash?+
Selectively, yes — we take small equity slugs in exchange for capped fee deferrals on filings, primarily for very-early-stage clients. Subject to MA ethics rule on attorney equity-in-client and to our internal investment-committee approval. Ask us if interested.
